ARTICLE XIII:

 

Legal Assistance

 

SECTION A.

 

PURPOSE

 

Members of the Organization are entitled to legal assistance at no additional cost to the member, in matters arising out of administrative proceedings initiated against the member by the Agency, relating to the scope of their employment with the Agency. A request for legal assistance shall be made to a member of the Board of Directors. After the member notifies a member of the Board of Directors, the member may then contact the Organization’s legal advisor.

 

SECTION B.

 

PROCEDURES

 

The Organization’s legal advisor shall, as soon as possible, contact the President of the Organization and advise him/her as to the feasibility of defending the member involved, and whether or not the legal advisor will in fact, defend the member.

 

SECTION C.

 

APPEALS

 

Members of the Organization shall only have the absolute right of counsel at the initial administrative hearing stage. Any request for additional legal representation, i.e., appeals, shall be submitted to the Legal Advisory Committee (LAC) for approval. Should approval become necessary, the member and the Organization’s attorney shall appear before the LAC at a time and place to be determined by the LAC. Should a member elect to choose his/her own attorney, the responsibility for all legal fees will be incurred by that member.
